Co-op Basics is an in-depth 2-session seminar for new directors. Attorney Marc Luxemburg and accountant Mark Shernicoff discuss all aspects of operating a cooperative and the diverse responsibilities of board members. Participants are encouraged to bring the their Proprietary Lease and bylaws and a monthly management statement to help them apply the course directly to their own situations. The class is limited to board members of cooperatives. Advanced registration is required. A light supper is served in the break. Building Code Seminar

The City’s new building code takes affect July 1, 2008. Some provisions apply to owners of existing buildings. Are you ready to meet the new code’s requirements? This seminar will give an overview of the key provisions of the new code and explain in detail what owners of existing buildings must do to comply with the code. Speakers include Phyllis Arnold, Esq., the Department of Building’s Deputy Commissioner for Legal Affairs and Chief Code Counsel, as well as other experts on the new code’s requirements. The seminar is co-sponsored with the Rent Stabilization Association and the New York County Lawyer’s Association (NYCLA). Attorneys can earn CLE credits for attending.
Cost: $35 for CHIP members and nonmembers who are NOT getting CLE credits. $75 for CHIP members getting CLE credits; $100 for non-CHIP members getting CLE credits.

Small cooperatives and condominium (20 units or smaller) face virtually all of the issues confronted in larger buildings, but their size limits the resource of people to cope with these issues, and full management responsibilities fall upon a small group of owners. At this meeting, board members in small buildings can share experiences and to catch up on ways to handle new issues, such as the recent city requirements regarding lead based paint and carbon monoxide detectors. ISSUES FOR NEW CONSTRUCTION COOPS & CONDOS

When occupied buildings are converted to cooperative or condominium status, negotiations generally occur causing some of the terms of the original offering plan to be modified. Reserve funds are sometimes increased; asking prices lowered. But purchasers of units in newly constructed buildings have no opportunity to negotiate the sponsor’s offering. These new owners often face unpleasant surprises as they take responsibility for their homes. Oliver Rosengart is an attorney and engineer who has for many years reviewed offering plans at the Real Estate Finance Bureau of the Office of the Attorney General of the State of New York. He and co-op/condo attorneys Steven Sladkus and Jeffrey Reich will discuss typical problems that arise in new construction cooperatives and condominiums and will suggest ways of coping. DEALING WITH COOP /CONDO OWNER DEFAULTS

The ripple effect of the economic downturn has been impacting a wider and wider swath of the nation's industries and people. Layoffs and unemployment will increase the pressure on New York City cooperatives and condominiums to consider the very real possibility that some sponsors, shareholders and unit owners will become unable to meet their obligations. Below market sales in a building can lower values for all units; but defaulted mortgages and bank takeovers can be just as devastating. Recent purchasers may find that the current market insufficient to cover the mortgage balance owed on their apartment. In this seminar, moderated by CNYC Chair Stuart Saft, representatives of the Attorney General’s Office and attorneys and managing agents experienced in handling defaults, will examine various default situations from the point of view of the Board that must make decisions in the best interest of their condominium or cooperative. What are the legal, financial, management and insurance issues that the Board should bear in mind in difficult times? What happens if a default occurs? How can the Board be proactive and still be compassionate? The experts will address these questions and the ones raised by participants. There is no fee for representatives of CNYC member cooperatives and condominiums or professional subscribers to attend this important seminar, but advance reservations are required.
